StudioMart Connect respects the intellectual property rights of others and expects all users, creators, broadcasters, and subscribers to do the same. This Copyright & DMCA Policy explains how StudioMart Connect handles copyright infringement claims and protects intellectual property rights.
Copyright Ownership
StudioMart Connect respects the intellectual property rights of others and expects all users, creators, broadcasters, and subscribers to do the same. Users may only upload, stream, broadcast, distribute, or share content that they own, or that they have permission or legal authorization to use. This includes but is not limited to: • Music • Videos • Livestreams • Podcasts • Images • Artwork • AI-generated content • TV broadcasts • Watch Parties • Promotional materials Users retain full ownership of the original content they create, upload, or share through the platform. By uploading content, you represent and warrant that you own or have obtained all necessary rights, licenses, and permissions to use, display, and distribute that content. Users are solely responsible for ensuring they have the rights necessary to use and distribute content uploaded to StudioMart Connect. StudioMart Connect does not claim ownership of user-generated content. However, by using the platform, you grant StudioMart Connect a limited, non-exclusive license to host, display, and distribute your content solely for the purpose of operating and improving the platform services.
Prohibited Content
Users may not upload, stream, broadcast, distribute, or otherwise make available content that infringes upon the copyright, trademark, or other intellectual property rights of any third party. Prohibited content includes, but is not limited to: • Infringes copyrights • Violates trademarks • Violates publicity rights • Violates licensing agreements • Contains unauthorized recordings • Contains pirated media • Contains unauthorized TV broadcasts • Contains unauthorized music recordings • Unauthorized copies of music, films, videos, or television programs • Unlicensed samples, loops, or beats used in tracks without permission • Re-broadcasting of copyrighted sports events, concerts, or performances • Pirated software, books, or digital media • Content that violates the intellectual property rights of creators, labels, or studios StudioMart Connect reserves the right to remove any content that violates this policy without notice.
DMCA Takedown Requests
If you believe that your copyrighted work has been copied and is accessible on StudioMart Connect in a way that constitutes copyright infringement, you may submit a DMCA takedown notice. Your notice must include the following information: 1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf 2. Identification of the copyrighted work claimed to have been infringed 3. Identification of the material that is claimed to be infringing, including its location on the platform 4. Your contact information, including address, telephone number, and email address 5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law 6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner Alternatively, the notice should include: • Full legal name • Contact information • Description of copyrighted work • Description of allegedly infringing content • URL(s) of the content • Statement of good faith belief • Statement under penalty of perjury that the information is accurate • Physical or electronic signature DMCA notices may be submitted through StudioMart Connect Support. Content Removal
Upon receiving a valid DMCA takedown notice, StudioMart Connect will promptly remove or disable access to the allegedly infringing material. We will notify the user who uploaded the content and provide them with a copy of the takedown notice, redacting any personal information as appropriate. Upon receiving a valid DMCA notice, StudioMart Connect may: • Remove content • Disable access to content • Restrict broadcasts • Suspend uploads • Temporarily suspend accounts • Terminate accounts for repeated violations Content may also be removed at StudioMart Connect's sole discretion if we determine, in good faith, that it violates our Terms of Service, Community Guidelines, or any applicable law, even in the absence of a formal DMCA notice.
Counter Notifications
If you believe that your content was removed or disabled by mistake or misidentification, you may submit a counter-notification. Your counter-notification must include: 1. Your physical or electronic signature 2. Identification of the material that has been removed or disabled, and the location where it appeared before removal 3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification 4. Your name, address, telephone number, and email address 5. A statement that you consent to the jurisdiction of the federal court in your district, or if outside the United States, any judicial district in which StudioMart Connect may be found, and that you will accept service of process from the person who provided the original DMCA notice 6. Repeat Infringer Policy
StudioMart Connect maintains a strict repeat infringer policy in accordance with the Digital Millennium Copyright Act (DMCA). Users who are subject to multiple valid copyright complaints may have their accounts terminated or suspended. We reserve the right to terminate any user's access to the platform if, under appropriate circumstances, the user is determined to be a repeat infringer. Accounts that repeatedly violate copyright laws may be subject to: • Warnings • Content removal • Account suspension • Permanent account termination • Removal from creator programs • Loss of monetization privileges A "repeat infringer" is generally defined as a user who has received three or more valid DMCA takedown notices within a twelve-month period. However, StudioMart Connect reserves the right to take action at any time based on the severity and pattern of infringement.
Watch Party Copyright Rules
Watch Parties on StudioMart Connect allow users to watch content together in real time. All participants in a Watch Party are responsible for ensuring that the content being shared does not infringe upon third-party copyrights. Users creating Watch Parties must have appropriate rights to any content being streamed, displayed, or shared. StudioMart Connect reserves the right to remove Watch Parties that violate copyright laws or licensing agreements. • Only content that you have the legal right to share may be broadcast during a Watch Party • Re-broadcasting or screen-sharing copyrighted films, television shows, sporting events, or music videos without authorization is strictly prohibited • The host of a Watch Party is solely responsible for the content streamed during that session • StudioMart Connect may terminate Watch Party sessions and suspend accounts for unauthorized copyright sharing • Participants should report any Watch Party they believe is sharing infringing content
AI Generated Content Responsibility
StudioMart Connect provides AI-powered tools that assist users in creating music, artwork, and other content. While these tools are designed to help spark creativity, users are solely responsible for ensuring that any AI-generated content they upload, publish, or distribute does not infringe upon the rights of others. Creators using AI tools remain responsible for ensuring that generated content does not infringe upon copyrights, trademarks, publicity rights, or other intellectual property rights. StudioMart Connect does not guarantee ownership rights for AI-generated content created through third-party services. • AI-generated content that reproduces or closely mimics existing copyrighted works may constitute infringement • Users may not use AI tools to generate content that impersonates real artists, actors, or public figures without permission • You retain full responsibility for any AI-assisted content you publish on the platform • StudioMart Connect does not guarantee that AI-generated outputs are free from third-party rights
Creator Responsibilities
All creators, artists, labels, broadcasters, content owners, and users who upload or broadcast content on StudioMart Connect are responsible for: • Ensuring they hold all necessary rights to the content they share • Obtaining proper licenses, permissions, clearances, and approvals for any samples, covers, remixes, or derivative works • Clearly labeling and crediting collaborators, co-writers, and rights holders • Responding promptly to any copyright claims or disputes related to their content • Keeping their account information accurate and up to date for legal correspondence Creators, labels, broadcasters, and content owners are responsible for obtaining all necessary licenses, permissions, clearances, and approvals required to distribute content through StudioMart Connect. Failure to meet these responsibilities may result in content removal, account suspension, or termination.
Limitation of Liability
To the fullest extent permitted by law, StudioMart Connect, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to copyright disputes, content removal, account suspension, or any other matter related to intellectual property on the platform. StudioMart Connect acts as a neutral hosting platform and is not responsible for monitoring all user content for copyright compliance. We rely on copyright holders and users to report potential infringements so that we can take appropriate action. StudioMart Connect acts as a platform provider and does not pre-screen all uploaded content. Users remain solely responsible for content they upload, stream, share, broadcast, or distribute. StudioMart Connect shall not be liable for unauthorized user conduct or intellectual property violations committed by users.
Policy Updates
StudioMart Connect reserves the right to update or modify this Copyright & DMCA Policy at any time. Changes will be posted on this page with an updated effective date. Continued use of the platform constitutes acceptance of any updated policy. Continued use of the platform after any changes constitutes acceptance of the revised policy.
